Facts
Miss Millhouse brought a claim against Jaan Services but failed to comply with a Tribunal Order dated 5 August 2025. Decision
Employment Judge Graham struck out the claim under Rule 38 of the Employment Tribunal Procedure Rules 2024 on the papers, finding that the grounds for strike out applied and that it was in accordance with the overriding objective. A scheduled hearing on 6 January 2026 was cancelled.
Practical note
Failure to comply with Tribunal orders and respond to unless orders will result in claims being struck out for non-pursuit, even without a hearing.
