1. About Tribunal Intelligence
Tribunal Intelligence (“the Service”) is operated by Andrew Jonathan Hooles trading as Tribunal Intelligence (“we”, “us”, or “our”). The Service provides data analytics and search functionality derived from publicly available employment tribunal decisions published by HM Courts & Tribunals Service.
By accessing or using the Service, you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, you must not use the Service.
2. Nature of the Service
2.1 Information service, not legal advice
The Service provides statistical analysis and structured data derived from publicly available employment tribunal decisions. It does not provide legal advice. Nothing on this website should be construed as legal advice or as creating a solicitor-client or other professional relationship. You should always seek independent legal advice from a qualified professional before making decisions based on information obtained from the Service.
2.2 Public source data
The data presented through the Service is derived from employment tribunal decisions published on the GOV.UK decisions register and other publicly available legal sources. We process and structure this data using automated tools, including artificial intelligence, to extract and categorise relevant information.
2.3 AI-assisted extraction
Data presented through the Service has been extracted and categorised using large language models and other automated processing methods. While we take reasonable steps to ensure accuracy, automated extraction may introduce errors. The Service should not be relied upon as the sole source of information for any matter of legal or commercial significance. Users should always verify critical information against the original tribunal decision.
3. Accuracy and Limitations
3.1 No warranty of accuracy
We make reasonable efforts to ensure the accuracy of the data presented, but we do not warrant that the information is complete, accurate, or up to date. Employment tribunal decisions may be amended, appealed, or revoked after publication. Statistical analyses, award calculations, and other derived data are produced algorithmically and may contain errors or inaccuracies.
3.2 Coverage
The Service does not purport to contain every employment tribunal decision. Coverage depends on the availability of decisions on public registers and our processing capacity. The absence of a decision from the Service does not mean it was not issued.
3.3 Timeliness
There may be a delay between the publication of a tribunal decision and its appearance on the Service. We do not guarantee any particular update frequency.
4. Accounts and Registration
4.1 Account creation
To access the Service, you must create an account by providing a valid email address and creating a password. You must provide accurate and complete information when registering and keep your account details up to date. You must not create an account using a false identity or on behalf of another person without their authorisation.
4.2 Account security
You are responsible for keeping your login credentials secure. You must not share your account with others or allow any other person to access the Service using your account. You are responsible for all activity that occurs under your account. If you become aware of any unauthorised use of your account, you must notify us immediately at contact@tribunalintelligence.co.uk.
4.3 Account termination by you
You may delete your account at any time through your account settings or by contacting us. If you have an active paid subscription, please see section 5.5 (Cancellation) below. Upon account deletion, we will delete your personal data in accordance with our Privacy Notice.
4.4 Account termination by us
We reserve the right to suspend or terminate your account at any time if we reasonably believe you have breached these Terms, or if your account has been inactive for 12 months or more. Where reasonably practicable, we will give you advance notice before terminating your account.
5. Subscriptions and Payment
5.1 Subscription plans
The Service offers both free and paid subscription plans. The features available under each plan, and the applicable pricing, are described on our website and may change from time to time. We will give reasonable notice of any changes to pricing or plan features that affect your current subscription.
5.2 Free plan
The free plan provides limited access to the Service. We reserve the right to modify, restrict, or discontinue the free plan at any time. Free plan users may be subject to usage limits, including limits on the number of searches or the scope of data accessible.
5.3 Paid plans
Paid plans provide full access to all features of the Service. Paid subscriptions are billed in advance on either a monthly or annual basis, as selected at the time of purchase. All prices are stated in pounds sterling and are inclusive of VAT where applicable.
5.4 Payment processing
Payments are processed securely by Stripe. By subscribing to a paid plan, you authorise us to charge the payment method you provide on a recurring basis at the applicable subscription rate. Stripe's terms of service apply to the processing of your payment. We do not store your full payment card details on our systems.
5.5 Cancellation
You may cancel your paid subscription at any time through your account settings. If you cancel, your subscription will remain active until the end of the current billing period. You will not be charged for subsequent billing periods after cancellation. No partial refunds are given for unused time within a billing period.
5.6 Refunds
If you are a consumer, you have the right to cancel your subscription within 14 days of your initial purchase under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, and receive a full refund. By using the Service during this 14-day period, you acknowledge that you are requesting immediate access to the digital content and that this may affect your cancellation rights. 5.7 Free trials
We may offer free trial periods for paid plans. At the end of a free trial, your subscription will automatically convert to a paid subscription at the applicable rate unless you cancel before the trial ends. We will remind you before your trial expires.
5.8 Price changes
We may change our subscription prices from time to time. Any price change will take effect at the start of the next billing period following notice of the change. If you do not agree to a price change, you may cancel your subscription before the new price takes effect.
6. Acceptable Use
You agree to use the Service only for lawful purposes and in accordance with these Terms. You must not:
- Use the Service in any way that breaches applicable law or regulation.
- Use automated tools (including scrapers, bots, or crawlers) to access the Service without our prior written consent.
- Attempt to gain unauthorised access to any part of the Service or its underlying systems.
- Reproduce, redistribute, or commercially exploit the structured data, analytics, or other outputs of the Service without our prior written consent.
- Use the Service to harass, intimidate, or cause distress to any individual named in tribunal decisions.
- Share your account credentials or allow others to access the Service through your account.
- Circumvent or attempt to circumvent any usage limits, access controls, or paywall restrictions.
7. Intellectual Property
7.1 Our rights
The design, layout, analytics, structured datasets, and software of the Service are owned by us or licensed to us and are protected by copyright, database rights, and other intellectual property rights. The underlying tribunal decisions are Crown copyright and are published under the Open Government Licence.
7.2 Limited licence
We grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Service for your own professional or personal purposes, subject to these Terms. This licence does not permit you to resell, sublicence, or redistribute data obtained from the Service.
8. Privacy and Data Protection
8.1 Personal data in tribunal decisions
Employment tribunal decisions are public documents published under the principle of open justice. The names of parties, representatives, and judges appearing on the Service are taken directly from published decisions. Where a tribunal has anonymised a decision, we respect that anonymisation.
8.2 Your personal data
We process your personal data in accordance with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018. Full details of what data we collect, how we use it, and your rights are set out in our Privacy Notice.
9. Limitation of Liability
9.1 Exclusion of liability
To the fullest extent permitted by law, we exclude all liability for any loss or damage arising from your use of or reliance on the Service, including but not limited to:
- Any inaccuracy or incompleteness in the data presented.
- Any decision made or action taken in reliance on information obtained from the Service.
- Any loss of profit, business, revenue, goodwill, or anticipated savings.
- Any indirect or consequential loss.
9.2 Cap on liability
Where we are found liable for any loss or damage in connection with your use of the Service, our total aggregate liability shall not exceed the greater of (a) the total subscription fees paid by you in the 12 months preceding the event giving rise to the claim, or (b) £100.
9.3 Consumer rights
Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited under English law. If you are a consumer, your statutory rights under the Consumer Rights Act 2015 are not affected by these Terms.
10. Availability
We do not guarantee that the Service will be available at all times or without interruption. We may suspend, withdraw, or restrict access to the Service at any time without notice. We will not be liable to you if the Service is unavailable for any reason. Where we plan extended maintenance that may affect access, we will endeavour to give advance notice.
11. Changes to These Terms
We may revise these Terms at any time by amending this page. Where changes are material, we will notify registered users by email at least 14 days before the changes take effect. Your continued use of the Service after any changes constitutes acceptance of the revised Terms. If you do not agree to the revised Terms, you should stop using the Service and cancel your subscription.
12. Governing Law and Jurisdiction
These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales. If you are a consumer, you may also bring proceedings in the courts of the country in which you are resident.
