Facts
The claimant, Mrs C Talaba, was employed by Care UK Community Partnerships Limited. She brought an unfair dismissal claim that was presented outside the normal three-month time limit. A preliminary hearing was held by video on 17 December 2025 to determine whether the claim should be allowed to proceed despite being late.
Decision
Employment Judge Taft determined that although the unfair dismissal claim was not presented within the applicable time limit, it was not reasonably practicable for the claimant to do so. Furthermore, the claim was presented within a further reasonable period. The claim will therefore be allowed to proceed to a full hearing on the merits.
Practical note
A self-represented claimant successfully overcame a time limit objection by demonstrating it was not reasonably practicable to present her unfair dismissal claim in time and that she presented it within a further reasonable period thereafter.
