Claimant v Intellectual Property Office
Outcome
Individual claims
The claim for statutory redundancy payment was withdrawn by the claimant and dismissed on that basis.
The tribunal found the complaint of direct race discrimination not well-founded. Although the time limit was extended on just and equitable grounds, the claim failed on its merits.
Facts
Ms Majothi brought claims against the Intellectual Property Office for statutory redundancy payment and direct race discrimination. The redundancy claim was withdrawn during the hearing. The race discrimination claim was presented out of time but the tribunal exercised its discretion to extend the time limit on just and equitable grounds.
Decision
The tribunal dismissed the redundancy payment claim on withdrawal. The race discrimination claim was permitted to proceed despite being out of time, but was dismissed as not well-founded on the merits after a two-day hearing.
Practical note
Even where a tribunal extends time limits on just and equitable grounds for a discrimination claim, the claim must still succeed on its substantive merits to result in an award.
