Facts
Mr Niall Robertson brought claims against his employer, the Department for Transport, including direct discrimination because of sex, direct discrimination because of sexual orientation, unauthorised deduction from wages, and other unspecified complaints. The case was heard over 10 days in November and December 2025 before a full tribunal panel with both parties represented by counsel.
Decision
The tribunal dismissed the entire claim. The claimant withdrew his complaints of sex discrimination, sexual orientation discrimination, and unauthorised deduction from wages during the hearing, which were dismissed pursuant to Rule 51. All remaining complaints were found to be not well-founded and dismissed.
Practical note
This case resulted in a complete loss for the claimant after a lengthy 10-day hearing, with some claims withdrawn during the proceedings and all remaining claims failing on their merits.
