Facts

The claimant, Mariusz Rydzicki, brought a claim against his former employer Narbuild Limited. The claimant did not attend the preliminary hearing held by CVP on 11 December 2025. The respondent was represented by Mr K Dekar, a company director. The tribunal proceeded in the claimant's absence under rule 47.

Decision

The tribunal found that the claim was presented outside the applicable time limit. Applying the reasonably practicable test, the tribunal concluded it was reasonably practicable for the claimant to have presented the claim in time. The claim was therefore dismissed in its entirety for being out of time.

Practical note

Claimants must strictly observe time limits and cannot rely on the 'reasonably practicable' exception unless there are genuine obstacles that prevented timely filing.
