Claimant v British Transport Police
Outcome
Individual claims
The claim was struck out by judgment dated 9 December 2025. The claimant's reconsideration application was refused as the matters raised were or could have been raised at the original hearing and the claimant was attempting to have a second opportunity to raise arguments already considered.
Facts
The claimant brought a disability discrimination claim against British Transport Police which was struck out by judgment dated 9 December 2025. On 25 December 2025 the claimant applied for reconsideration, arguing the tribunal had not seen certain documents, that his personal beliefs were protected under Article 9 ECHR, and that the respondent should not have relied on incidents at Kings Cross or rejected him without consulting occupational health.
Decision
The tribunal refused the reconsideration application under Rule 70, finding no reasonable prospects of the judgment being varied or revoked. The judge held that all the matters raised were or could have been raised at the original hearing and the claimant was simply attempting to have another opportunity to argue his case.
Practical note
A reconsideration application is not an opportunity to re-argue matters that were or could have been raised at the original hearing.
