Facts
The claimant Karl Ahmed brought a claim against Proman Recruitment Ltd. The tribunal issued an order on 25 June 2025 which the claimant failed to comply with. The tribunal wrote to the claimant on 22 October 2025 warning that the claim would be struck out for having no reasonable prospect of success, non-compliance with the order, and failure to actively pursue the claim. The claimant did not respond to this warning.
Decision
Employment Judge Povey struck out the claim under Rule 38 of the Employment Tribunal Procedure Rules 2024. The judge was satisfied that the grounds for strike out applied and that it was in accordance with the overriding objective to strike out the claim, given the claimant's non-compliance and lack of response.
Practical note
Failure to comply with tribunal orders and respond to strike-out warnings will result in claims being struck out for non-pursuit, even without a hearing.
