Claimant v St. Mungo Community Housing Association
Outcome
Individual claims
Claim struck out for non-compliance with Tribunal orders dated 9th September 2025 and 14th October 2025, and for failure to actively pursue the claim. The claimant did not respond to the unless order warning letter dated 13th November 2025.
Facts
Miss Ismael brought a claim against St. Mungo Community Housing Association. The Tribunal issued orders on 9th September 2025 and 14th October 2025 which the claimant failed to comply with. On 13th November 2025, the Tribunal wrote warning the claimant that the claim would be struck out for non-compliance and failure to actively pursue the claim, giving her an opportunity to respond. The claimant did not reply to this warning letter.
Decision
Employment Judge Gray struck out the claim under Rule 38 of the Employment Tribunal Procedure Rules 2024 for non-compliance with tribunal orders and failure to actively pursue the claim. The judge was satisfied that strike out was in accordance with the overriding objective and the scheduled hearing for 13th-14th May 2026 was cancelled.
Practical note
Unrepresented claimants must comply with tribunal orders and actively pursue their claims, as failure to respond even to unless order warnings will result in strike out on the papers without a hearing.
