Claimant v Organic Restaurant Management Ltd
Outcome
Individual claims
The tribunal found the respondent made an unauthorised deduction from the claimant's wages during the period February to April 2025. The respondent did not attend to defend the claim and the tribunal was satisfied the complaint was well-founded.
The tribunal found the respondent made an unauthorised deduction by failing to pay the claimant for holidays accrued but not taken when his employment ended. The claimant had applied to amend his claim to include this complaint and the amendment was granted.
Facts
The claimant was employed by a restaurant management company. During February to April 2025 the respondent made unauthorised deductions from his wages totalling £2,572.47. When his employment ended in April 2025, the respondent failed to pay him for accrued but untaken holiday worth £1,207.50. The claimant applied to amend his claim to include the holiday pay complaint.
Decision
The tribunal granted the amendment application and found both complaints well-founded. The respondent did not attend the hearing to defend the claims. The tribunal awarded the claimant £3,779.97 representing the unpaid wages and accrued holiday pay.
Practical note
Where an employer fails to attend a hearing to defend wage deduction claims, the tribunal can make a default judgment awarding the claimant the amounts claimed if satisfied the complaints are well-founded.
