Facts
Mr Dunlop brought claims against Asda Stores Limited for unfair dismissal and unlawful deduction of wages. A preliminary hearing was held remotely by CVP on 25 November 2025 to determine whether the tribunal had jurisdiction to hear the claims.
Decision
The tribunal found that it had no jurisdiction to hear the claims because they were presented out of time and it was reasonably practicable for the claimant to have presented them in time. Both claims were dismissed.
Practical note
Employment tribunals will strictly enforce time limits when claimants fail to demonstrate it was not reasonably practicable to file their claims within the statutory deadline.
