Claimant v Scottish Police Authority
Outcome
Individual claims
Claim struck out under rule 47 for non-attendance at case management preliminary hearing on 17 November 2025. Claimant had previously failed to attend hearing on 12 August 2025, had not complied with tribunal orders to provide medical records, disability impact statement and schedule of loss, and had no contact with tribunal since solicitor withdrew on 7 July 2025.
Facts
Claimant brought disability discrimination complaints against Scottish Police Authority and was initially represented by solicitors. At case management hearing on 28 November 2024, orders were made for claimant to provide medical records, disability impact statement and schedule of loss. Claimant's solicitors withdrew on 7 July 2025. Claimant failed to attend case management hearing on 12 August 2025, which was vacated and relisted for 17 November 2025. Claimant again failed to attend on 17 November 2025 despite notice being sent to her personal email address.
Decision
Tribunal dismissed all complaints under rule 47 for non-attendance. Claimant had not attended two consecutive case management hearings, had not complied with tribunal orders, and had made no contact with tribunal or respondent since her solicitor withdrew. Tribunal waited 15 minutes and attempted to contact claimant by phone and email before dismissing the claims.
Practical note
Unrepresented claimants risk strike-out under rule 47 if they fail to attend case management hearings and do not maintain contact with the tribunal, even where they were previously represented and have legitimate disability discrimination claims.
