Facts
Robin Kendal Priestley brought claims of unfair dismissal and wrongful dismissal against the Export Credits Guarantee Department (a government body). The claimant appeared in person at a preliminary hearing held remotely by CVP. The respondent was represented by counsel Richard Ryan. The tribunal did not determine the merits of the case.
Decision
Employment Judge Elliott dismissed both claims on the basis that they were presented outside the applicable time limits and it was reasonably practicable for the claimant to have presented them in time. The tribunal therefore had no jurisdiction to hear the claims.
Practical note
Strict time limits apply to employment tribunal claims, and unrepresented claimants must still comply with them; even meritorious claims will be dismissed if brought out of time where it was reasonably practicable to present them on time.
