Facts
The claimant was employed by the respondent from 29 May 2022 until dismissal on 15 April 2024. She had a history of anxiety and had received psychotherapy in 2019-2020 and 2022. On 29 August 2023 her GP diagnosed Generalised Anxiety Disorder and prescribed beta blockers for panic attacks. She attended A&E on 11 April 2024 with anxiety symptoms. Evidence showed she maintained an active social life at work including organising weekly social drinks and attending work events throughout her employment. GP records and independent evidence showed limited impact on day-to-day activities.
Decision
The tribunal found that while the claimant had a mental impairment (Generalised Anxiety Disorder), the adverse effect on her ability to carry out normal day-to-day activities did not reach the threshold of 'more than minor or trivial' required for disability status under s6 Equality Act 2010. Independent evidence demonstrated regular participation in normal activities throughout employment. The disability discrimination claim was therefore dismissed.
Practical note
To establish disability status under the Equality Act, independent objective evidence of substantial adverse effect on day-to-day activities is essential; subjective accounts alone are insufficient where they conflict with documented regular participation in normal activities.
