Facts
Ms Levy brought claims against her former employer, an accountancy firm in creditors' voluntary liquidation, for notice pay, holiday pay and unpaid wages. The respondent did not appear at the hearing. The claims were presented outside the applicable statutory time limits.
Decision
The tribunal dismissed all three claims on the basis that they were presented out of time and it was reasonably practicable for the claimant to have presented them within the applicable time limit. The claimant represented herself and the respondent did not attend.
Practical note
Even where a respondent is insolvent and does not participate, claimants must still comply with strict time limits and tribunals will dismiss out-of-time claims where it was reasonably practicable to present them in time.
