13 November 2025Before Employment Judge HarrisonReadingremote video

Outcome

Claimant succeeds£1,048

Individual claims

Unlawful Deduction from Wagessucceeded

The tribunal found that the respondent made unauthorised deductions from the claimant's pay in December 2024 contrary to Part II Employment Rights Act 1996, and ordered the respondent to pay the gross sum of £1,048.41.

Breach of Contractsucceeded

The claim for breach of contract relating to a failure to pay notice was well-founded, however the remedy sought had already been fully addressed through the unauthorised deductions claim, so no additional award was made.

Facts

Mr Peacock brought claims against Berkshire Music Trust for unauthorised deductions from wages and breach of contract relating to notice pay. The respondent made unauthorised deductions from his pay in December 2024. The matter was heard remotely by CVP at Reading Employment Tribunal.

Decision

The tribunal found both claims well-founded. The respondent was ordered to pay £1,048.41 gross for the unauthorised deductions. Although the breach of contract claim regarding notice pay also succeeded, no additional remedy was awarded as the sum sought was already covered by the unauthorised deductions award.

Practical note

Where unauthorised deductions and breach of contract claims relate to the same sum, tribunals will avoid double recovery by addressing the remedy once even where both claims succeed.
