Decision
The tribunal found both claims well-founded. The respondent was ordered to pay £1,048.41 gross for the unauthorised deductions. Although the breach of contract claim regarding notice pay also succeeded, no additional remedy was awarded as the sum sought was already covered by the unauthorised deductions award.
Practical note
Where unauthorised deductions and breach of contract claims relate to the same sum, tribunals will avoid double recovery by addressing the remedy once even where both claims succeed.
