Facts
The claimant was an employee of Achieve Together Limited who was absent from work due to sickness. Under her contract of employment, she was entitled to full contractual sick pay (inclusive of SSP) for a period of 6 months. The respondent failed to pay the claimant her full contractual sick pay entitlement from 12th March 2024 onwards. The claimant brought claims including unlawful deduction of wages and potentially other claims which were not successful.
Decision
The tribunal found in favour of the claimant on her unlawful deduction of wages claim, ruling that the respondent had made a series of unauthorised deductions by failing to pay full contractual sick pay for 6 months from 12th March 2024. All other claims brought by the claimant were dismissed. Remedy was adjourned to allow the parties to attempt to agree the amount owed.
Practical note
Employers must honour contractual sick pay entitlements even where they exceed statutory sick pay, and failure to do so constitutes an unlawful deduction of wages under the Employment Rights Act 1996.
