Facts

Ms Reynolds brought two employment tribunal claims against Wigan Council and Orian Solutions Ltd in 2021. The tribunal wrote to the claimant on 28 October 2025 giving her an opportunity to make representations or request a hearing as to why the claims should not be struck out for non-pursuit. The claimant failed to respond or make any sufficient representations.

Decision

The tribunal struck out both claims on the basis that they had not been actively pursued by the claimant. After giving the claimant a final opportunity to show cause why the claims should continue, and receiving no adequate response, the tribunal exercised its power to strike out the claims.

Practical note

Claimants must actively pursue their claims and respond to tribunal correspondence, or risk having their claims struck out for want of prosecution.
