Claimant v The Q2 Signature Group Ltd
Outcome
Individual claims
The tribunal found that the respondent made unauthorised deductions from the claimants' wages in the period 1 June 2024 to 30 June 2024. The respondent failed to attend or respond to the claims, and the claimants gave evidence supporting their complaints.
The tribunal found that the respondent breached the claimants' contracts by failing to pay notice pay. The claims were well-founded based on the claimants' evidence presented at the hearing where the respondent did not attend.
Under section 163 Employment Rights Act 1996, Mr Samuel Palmer was determined to be entitled to a statutory redundancy payment based on his service and circumstances of termination.
Facts
Four employees of Q2 Signature Group Ltd brought claims for unpaid wages and notice pay following termination of their employment around June 2024. The respondent failed to pay wages for the period 1-30 June 2024 and failed to pay notice pay upon termination. Despite the claimants' repeated efforts to contact the respondent, they received no response. The respondent did not attend the hearing or defend the claims.
Decision
The tribunal found all claims for unauthorised deductions from wages and breach of contract (notice pay) to be well-founded. Mr Joe Lennon was awarded £3,063.20 in unpaid wages, £650 compensation for financial loss, and £2,500 notice pay. Mr Samuel Palmer was awarded £2,083.33 unpaid wages, £2,083.33 notice pay, and £1,040 statutory redundancy payment. Mr George Thomas and Miss Maddison Pegg were each awarded their respective unpaid wages and notice pay.
Practical note
A default judgment will be entered against an employer who fails to respond to proceedings or attend a hearing, with the tribunal accepting the claimants' evidence as to unpaid wages and contractual entitlements.
