Claimant v Prolojik Limited
Outcome
Individual claims
The equal pay claim based on work of equal value under section 65(1)(c) EQA continues with three comparators: Mr Rodrigo, Mr Vincent, and Mr Karimjee. The claim has not been struck out and will proceed to full hearing.
The equal pay claim based on like work under section 65(1)(a) EQA was no longer being pursued by the claimant and was dismissed on withdrawal.
The equal pay claim based on work rated as equivalent under section 65(1)(b) EQA was no longer being pursued and the claimant confirmed there would be no application to amend to add this allegation.
Facts
This was a preliminary hearing concerning an equal pay claim. The claimant had brought claims based on three different types of equal work under the Equality Act 2010: like work, work rated as equivalent, and work of equal value. The respondent appears to have applied to strike out parts of the claim. The claimant had identified three male comparators: Mr Rodrigo, Mr Vincent, and Mr Karimjee.
Decision
The tribunal refused to strike out any part of the claim. The equal pay claim based on work of equal value will proceed with the three identified comparators. However, the claims based on like work and work rated as equivalent were withdrawn or not pursued, and were dismissed on withdrawal. The tribunal also awarded costs of £1,400 against the claimant, payable by 1 December 2025.
Practical note
In equal pay claims, claimants can pursue claims based on work of equal value even if they withdraw or abandon claims based on like work or work rated as equivalent, but may face costs consequences for changing their position.
