Facts
This was a group claim involving 19 claimants (18 named plus one duplicate case) against two local authority respondents: Cumberland Council and Westmorland & Furness Council. The claims were filed in 2023 and 2024. On 24 July 2025, the tribunal issued a warning letter giving the claimants an opportunity to make representations or request a hearing as to why the claims should not be struck out for non-pursuit.
Decision
Employment Judge Cookson struck out all claims on papers on 4 November 2025. The tribunal found that the claimants had failed to make any representations in writing, or failed to make sufficient representations, in response to the unless order and had not requested a hearing. The claims were therefore struck out for non-pursuit.
Practical note
Unrepresented claimants in group litigation must actively respond to tribunal warnings about strike-out for non-pursuit, or their claims will be dismissed without a hearing.
