Facts
The claimant, a Night Replenishment Colleague at Asda, originally filed an age discrimination claim in February 2025. She was off sick between June 2024 and February 2025 with degenerative disc disease and bulging discs. After receiving pro bono advice from ELIPs in May 2025, she realised her conditions might constitute a disability and applied in June 2025 to amend her claim to add disability discrimination claims. She alleged the respondent required heavy lifting and working alone, which aggravated her back conditions, and failed to contact her during extended sick leave. She also raised two grievances (July 2023 and January 2025) and sought to add victimisation claims.
Decision
Employment Judge Choudry allowed most amendments at a preliminary hearing held remotely on 27 October 2025. Amendments for failure to make reasonable adjustments, direct disability discrimination, discrimination arising from disability, and one victimisation claim (relating to January 2025 grievance) were permitted, subject to time limit issues being determined at final hearing. However, the victimisation claim relating to the July 2023 grievance was refused due to absence of any discrimination allegation in that grievance and a two-year delay.
Practical note
Tribunals will allow disability discrimination amendments even when made months after the original claim if sought at an early procedural stage and the claimant can explain the delay, but victimisation claims require the protected act to contain an allegation of discrimination.
