Facts

Mr Miah, representing himself, brought claims against London Borough of Hackney for constructive dismissal and discrimination on grounds of race and religion. He had originally brought additional discrimination claims on grounds of sex, sexual orientation, and disability, but abandoned these at a preliminary hearing in February 2025. An application to amend to add associative disability discrimination was refused in September 2025.

Decision

After a four-day hearing in October 2025, Employment Judge Palmer dismissed all of Mr Miah's claims. The tribunal found he had not established a fundamental breach of contract to support constructive dismissal, nor had he established less favourable treatment because of race or religion.

Practical note

A self-represented claimant bringing multiple discrimination claims alongside constructive dismissal must provide sufficient evidence to establish both fundamental breach of contract and a causal link between protected characteristics and alleged less favourable treatment.
