Automatic Unfair Dismissalfailed

Victimisationfailed

The tribunal found the claimant's question about the relevance of age during the disciplinary hearing was not a protected act, as there was no indication it was raised in connection with the Equality Act or any concern about age discrimination. Even if it were a protected act, the dismissal was because of the abusive language, not the question.

Unlawful Deduction from Wagesfailed

The tribunal accepted the respondent's evidence that the claimant was paid all sums owed to him. The payroll adjustments and balancing payments were made appropriately following his summary dismissal on 21 November 2023.

Facts

The claimant, a 27-year-old warehouse picker, made an abusive homophobic comment ('fucking faggot') to an 18-year-old colleague, Sean Wooding, on 1 November 2023. Sean Wooding became agitated and left the freezer warehouse. The claimant was suspended and later dismissed for gross misconduct after a disciplinary process. During the disciplinary hearing, the claimant alleged Sean Wooding had threatened him with a knife, though this was not visible on CCTV. The claimant also questioned the relevance of age being discussed during the hearing.

Decision

The tribunal dismissed all claims. The dismissal was for gross misconduct (use of abusive homophobic language), not for raising a health and safety concern. The use of the word 'faggot' justified summary dismissal without notice pay. There was no evidence of less favourable treatment on grounds of age in route allocation, early leaving, or dismissal. The claimant's question about age during the hearing was not a protected act for victimisation purposes. All wages owed were paid.

Practical note

A claimant raising a health and safety concern during disciplinary proceedings for misconduct that had already occurred will not succeed under s.100 ERA unless the concern itself was the reason for dismissal; using homophobic slurs constitutes gross misconduct justifying summary dismissal.
