Facts

Two claimants, Mr Leon Render and Mr Billy Wilson, brought claims against their former employer Hornbees Waste Management Ltd following redundancy dismissals. Both claimants appeared in person at the hearing while the respondent was represented by its director Mr P Davies. The respondent had paid some redundancy payment but not the full statutory amount owed to each claimant. The claims were presented out of time.

Decision

The tribunal found that it was not reasonably practicable for the claimants to present their claims in time and that they were presented within a reasonable time thereafter. The tribunal determined both claimants were dismissed by reason of redundancy and ordered the respondent to pay the balance of statutory redundancy payments: £945 to Mr Render and £1,050 to Mr Wilson.

Practical note

Employers must pay the full statutory redundancy payment owed and tribunals will extend time limits where it was not reasonably practicable to claim in time.
