The remaining allegations of harassment related to disability not withdrawn by the claimant failed on their merits and were dismissed by the tribunal.
Facts
Mr Gerc brought claims of direct disability discrimination and harassment related to disability against Mr Urubusi and Alma Valley Healthcare Ltd, a healthcare company. The case proceeded to a three-day full merits hearing in Southampton. The claimant represented himself while Mr Urubusi appeared for both respondents. During the hearing, the claimant withdrew certain allegations (1.2.3, 1.2.4, 2.1.3 and 2.1.4).
Decision
The tribunal dismissed the withdrawn allegations on withdrawal and found that all remaining allegations of direct disability discrimination and harassment related to disability failed and were dismissed. The claimant's claims were therefore wholly unsuccessful.
Practical note
An unrepresented claimant's disability discrimination and harassment claims against a healthcare employer failed entirely after a three-day hearing, with some allegations withdrawn during proceedings.
