Facts

Mr Bulgen brought claims against his former employer Net-Com (92) Limited for breach of contract relating to notice pay, arrears of holiday pay, unlawful deductions from wages, and other payments. He also initially claimed failure to provide written terms and conditions under s.1 ERA 1996. The matter proceeded to a one-day video hearing at East London with the claimant represented by his wife and the respondent by a consultant.

Decision

The tribunal dismissed all of the claimant's claims. The claims for notice pay, holiday pay, unlawful deductions from wages and other payments all failed on their merits. The claim for failure to provide terms and conditions was withdrawn by the claimant and dismissed upon withdrawal.

Practical note

This case demonstrates that even with lay representation on both sides, claimants must satisfy the tribunal on the merits of their wage and contract claims, and all claims failed here after a full hearing.
