The tribunal dismissed the claimant's claim for holiday pay at a preliminary hearing, finding that the claim failed on its merits.
Facts
Mr Anseur Rahman brought claims against Allcures Plc for unlawful deductions from wages and holiday pay. The matter came before the tribunal at a preliminary hearing conducted remotely by CVP at Watford Employment Tribunal. At the hearing, the claimant's name was corrected from the erroneous 'Mr Suwara Rahman' as stated on the ET1 form, and the respondent's name was amended by consent to Allcures Plc.
Decision
Employment Judge Tuck KC dismissed both of the claimant's claims at the preliminary hearing stage. The tribunal found that both the unlawful deductions from wages claim and the holiday pay claim failed and dismissed them accordingly.
Practical note
This case demonstrates that wage and holiday pay claims can be determined and dismissed at preliminary hearing stage where the tribunal finds they have no reasonable prospect of success.
