Facts

Mr Joshua Thompson brought claims against his former employer MXTreality Limited, a technology company. The claims related to unfair dismissal, profit share disputes, failure to pay backdated pay in June 2024, and failure to provide payslips between August and November 2024. The claimant appeared in person while the respondent was represented by Mr Toby Pettinger. The hearing took place over two days by video link.

Decision

The tribunal found that Mr Thompson was unfairly dismissed and awarded him compensatory damages of £2,281.83. The tribunal also upheld his claim for backdated pay from June 2024, awarding £2,500 gross, and found the respondent had unlawfully failed to provide payslips. However, the claim for profit share failed, and claims for redundancy pay and bonus were withdrawn.

Practical note

Employers must maintain proper payroll practices including providing payslips and honouring backdated pay agreements, and ensure dismissals follow fair procedures even in small technology companies.
