Claimant v Your Place (London) Limited
Outcome
Individual claims
The claim was presented outside the statutory time limit and the tribunal found it was reasonably practicable for the claimant to have presented the claim in time. Therefore the tribunal does not have jurisdiction to hear the claim and it was dismissed.
Facts
Miss L Turner brought a claim for unfair dismissal against Your Place (London) Limited. The claim was presented outside the statutory time limit. A preliminary hearing was held to determine whether the tribunal had jurisdiction to hear the claim.
Decision
Employment Judge Park found that the claim was presented outside the applicable time limit and that it was reasonably practicable for the claimant to have presented it in time. The tribunal therefore had no jurisdiction to hear the claim and it was dismissed.
Practical note
Unrepresented claimants must comply strictly with time limits for unfair dismissal claims, and the 'reasonably practicable' extension test is difficult to satisfy.
