8 October 2025Before Employment Judge Hutchingson papers

Outcome

Claimant fails

Individual claims

Otherstruck out

The claim was struck out because the claimant failed to comply with the Tribunal's Order dated 25 June 2025 and failed to actively pursue the claim. The claimant did not respond to the Tribunal's letter dated 4 September 2025 offering an opportunity to make representations or request a hearing.

Facts

Mr L Wood brought a claim against Central Bedfordshire Council. The Tribunal made an Order on 25 June 2025 which the claimant failed to comply with. On 4 September 2025, the Tribunal wrote to the claimant giving him an opportunity to make representations or request a hearing as to why the claim should not be struck out for non-compliance and failure to actively pursue the claim. The claimant did not respond.

Decision

The Tribunal struck out the claim due to the claimant's failure to comply with a previous Order and failure to actively pursue the claim. The claimant was given an opportunity to respond but did not do so. The scheduled hearing for 9 October 2025 was cancelled.

Practical note

Claimants must comply with Tribunal orders and actively pursue their claims or risk having them struck out for non-pursuit, even without a hearing if they fail to respond to unless orders.
