Facts
Mrs Langridge brought multiple claims of indirect discrimination based on marriage and race (British nationality) against the Ministry of Defence, relating to various employment provisions including pension schemes, Victoria payments, saving schemes, legal insurance, consultation regarding pay negotiations, and an Inflation Relief Bonus. The Respondent applied to strike out these claims on the basis they had no reasonable prospect of success.
Decision
The tribunal struck out most of the indirect discrimination claims finding they had no reasonable prospect of success. However, the strike-out application was refused in relation to claims concerning the Inflation Relief Bonus. The parties subsequently reached a settlement on this remaining claim and agreed terms for the entire case to be dismissed.
Practical note
Multiple claims of indirect discrimination based on marriage and British nationality can be struck out at a preliminary stage where the tribunal finds they have no reasonable prospect of success, but settlement can still be achieved on claims that survive strike-out applications.
