Unlawful Deduction from Wagessucceeded

The tribunal found the respondent made unauthorised deductions from wages due in August 2024 and September 2024. The claimant was owed £6,413.10 in total wages including tips, hourly pay, accrued holiday pay and housing deposit. After authorised deductions of £2,491.24 for rent and cleaning, the respondent failed to pay the balance of £3,921.86.

Facts

The claimant worked for the respondent, a hospitality company, from 18 April 2023 to 3 August 2024. He was paid £15-16 per hour plus guaranteed tips of £3.50 per hour. The respondent also provided accommodation and deducted rent from wages. After the claimant left employment, the respondent failed to pay final wages for July and August 2024, including base pay, tips, accrued holiday pay, and return of housing deposit. Some deductions for rent and cleaning were authorised by the claimant.

Decision

The tribunal found in favour of the claimant and awarded £3,921.86 for unauthorised deductions from wages. The respondent was ordered to pay wages totalling £6,413.10 less authorised deductions of £2,491.24 for accommodation and cleaning charges. The respondent did not attend the hearing to defend the claim.

Practical note

Employers must pay all wages due including tips and accrued holiday pay on termination of employment, and can only make deductions that are expressly authorised by the employee or required by law.
