Claimant v Royal Mail Group Limited
Outcome
Individual claims
The claim was struck out for non-pursuit. The claimant failed to comply with the Tribunal's Order dated 17 June 2025 and failed to make representations or request a hearing in response to the unless order dated 8 August 2025.
Facts
Mr Hilton brought a claim against Royal Mail Group Ltd. The Tribunal made an Order on 17 June 2025 which the claimant failed to comply with. On 8 August 2025 the Tribunal wrote giving the claimant an opportunity to make representations or request a hearing as to why the claim should not be struck out for non-compliance and/or failure to actively pursue the claim. The claimant failed to respond or make representations.
Decision
Employment Judge Phil Allen struck out the claim on the papers due to the claimant's failure to comply with the previous Tribunal Order and failure to make any representations or request a hearing when given the opportunity. The hearing scheduled for 5-6 February 2026 was cancelled.
Practical note
Claimants must comply with Tribunal Orders and respond to unless orders, or face strike-out for non-pursuit without a hearing on the merits.
