Facts
Ms Stichova brought claims of age, sex and sexual orientation discrimination against an individual respondent. She appeared in person by telephone from Greece. The respondent was represented by a solicitor. The claims were pursued at a preliminary hearing conducted remotely by CVP.
Decision
The Tribunal found it had no jurisdiction to hear the discrimination claims as they were submitted outside the statutory time limit under section 123(1)(a) of the Equality Act 2010, and it was not just and equitable to extend time. The Tribunal also noted that the claims would have been struck out for having no reasonable prospect of success.
Practical note
Strict time limits apply to discrimination claims and tribunals will not extend time unless it is just and equitable to do so; even unrepresented claimants must comply with these limits.
