Claimant v Reeves of Sheringham Limited
Outcome
Individual claims
Both claimants brought claims for unauthorised deductions from wages which the tribunal found to be well-founded. The respondent did not attend the hearing to contest the claims, and the tribunal was satisfied on the evidence presented that wages had been unlawfully withheld.
Mr D. Warner's complaint of wrongful dismissal was found to be well-founded by the tribunal. The respondent failed to attend to defend the claim, and the tribunal was satisfied that the claimant had been dismissed without proper notice or payment in lieu thereof.
Facts
Two claimants, Mr D. Warner and Ms C. Uhlmann, brought claims against their former employer Reeves of Sheringham Limited for unauthorised deductions from wages. Mr Warner also brought a claim for wrongful dismissal. The respondent failed to attend the hearing to defend the claims.
Decision
The tribunal found both claims for unauthorised deductions from wages to be well-founded and awarded unpaid wages to both claimants. Mr Warner's wrongful dismissal claim also succeeded, and he was awarded damages for notice pay. The total awards were £5,568.57 to Mr Warner and £3,183.92 to Ms Uhlmann.
Practical note
Employers who fail to attend tribunal hearings risk having judgments entered against them by default where claimants can establish their claims on the evidence presented.
