Outcome
Individual claims
The tribunal heard the case over five days and concluded that the claimant had not established that she was treated less favourably because of her disability. The claim under section 13 Equality Act 2010 was not well founded.
The tribunal found that the claimant did not succeed in proving discrimination arising from disability under section 15 Equality Act 2010. The claim was not well founded after consideration of all evidence presented during the five-day hearing.
The tribunal determined that the respondent had not failed to make reasonable adjustments as required under section 21 Equality Act 2010. The claim was not well founded and was dismissed.
Facts
Mrs C Mears brought claims against The Cabinet Office alleging direct disability discrimination, discrimination arising from disability, and failure to make reasonable adjustments. The case was heard over five days in September 2025 before Employment Judge Park at the East London Hearing Centre. Both parties were represented by counsel. The tribunal heard evidence and submissions from both sides regarding the disability discrimination allegations.
Decision
The tribunal dismissed all of the claimant's claims, finding that none were well founded. The tribunal concluded that the claimant had not established direct disability discrimination under section 13, discrimination arising from disability under section 15, or failure to make reasonable adjustments under section 21 of the Equality Act 2010. Reasons were given orally at the hearing.
Practical note
A claimant bringing multiple disability discrimination claims against a public sector employer must establish each element of discrimination with sufficient evidence, and failure to do so will result in dismissal of all claims even after a five-day hearing.
