Facts

Mr Sarkar, a claimant in person, brought multiple discrimination claims against his employer, Imperial College Healthcare NHS Trust. The claims included direct discrimination on grounds of disability, sex and race, failure to make reasonable adjustments for disability, and harassment related to race. On the first day of the five-day full merits hearing, he withdrew his direct disability discrimination claim.

Decision

The tribunal dismissed all of Mr Sarkar's claims. The direct disability discrimination claim was dismissed following withdrawal. The remaining claims for direct sex and race discrimination, failure to make reasonable adjustments, and race-related harassment were all dismissed after failing on their merits. Oral reasons were given at the hearing but not recorded in this written judgment.

Practical note

A litigant in person facing well-represented NHS trust counsel was unsuccessful across multiple discrimination claims following a five-day hearing.
