Claimant v St Stephens Pre School CIC
Outcome
Individual claims
The tribunal found that the respondent made an unauthorised deduction from the claimant's wages in the period 1-28 March 2025, awarding the gross sum of £1531.05 that was deducted.
The tribunal found the complaint of breach of contract in relation to notice pay was well-founded. The claimant was entitled to seven weeks' notice pay which had not been provided.
Under section 163 Employment Rights Act 1996, the tribunal determined the claimant was entitled to a redundancy payment based on seven years' continuous service, all at age over 41, giving a multiplier of 10.5.
Facts
Mrs Scofield worked for St Stephens Pre School CIC for seven years. Her employment ended on 28 March 2025. The respondent made unauthorised deductions from her wages for the period 1-28 March 2025, failed to pay notice pay for the seven-week contractual notice period, and did not pay her statutory redundancy payment. The respondent did not attend the hearing.
Decision
The tribunal found all three claims well-founded. The respondent was ordered to pay £1531.05 for unauthorised deductions from wages, £2679.34 for notice pay, and £4018.50 as a statutory redundancy payment, totalling £8228.89.
Practical note
Where an employer fails to attend a hearing and the claimant provides evidence of entitlement to wages, notice pay and redundancy, the tribunal will make awards in the claimant's favour on all properly evidenced claims.
