Outcome
Individual claims
The claim was not presented within the applicable time limit and the tribunal found it was reasonably practicable to have done so, resulting in dismissal of this claim.
The claim was not presented within the applicable time limit and the tribunal found it was reasonably practicable to have done so, resulting in dismissal of this claim.
Facts
Miss Nosek brought claims for breach of contract/notice pay and unlawful deduction from wages against Miss Demiseviciute, an individual employer. Both parties appeared unrepresented at the preliminary hearing held remotely. The claimant was supported by her friend Miss S Booth. The tribunal determined the claims were presented outside the applicable time limits.
Decision
The tribunal dismissed all claims on the basis that they were not presented within the applicable time limit and that it was reasonably practicable for the claimant to have presented them in time. The claims for breach of contract/notice pay and unlawful deduction from wages therefore failed on jurisdictional grounds.
Practical note
Strict time limits apply to employment tribunal claims and claimants must comply with them where it is reasonably practicable to do so, or risk having their claims dismissed without consideration of the merits.
