Claimant v NSC Global Limited

4 September 2025Before Employment Judge Richard Woodremote video

Outcome

Claimant fails

Individual claims

Otherstruck out

All claims were dismissed as the tribunal found it did not have jurisdiction to hear them because the ET1 claim form was lodged outside the statutory time limits.

Facts

Mr Jones brought employment tribunal claims against NSC Global Limited but lodged his ET1 claim form outside the statutory time limits. A preliminary hearing was held remotely by video on 4 September 2025 to determine whether the tribunal had jurisdiction to hear the claims. Mr Jones represented himself and the respondent was represented by in-house counsel Mr L Dal Bianco.

Decision

Employment Judge Richard Wood dismissed all claims, finding that the tribunal did not have jurisdiction to hear them because the ET1 had been lodged out of time. The claimant's case could not proceed due to missing the statutory deadline for bringing employment tribunal claims.

Practical note

Time limits for lodging employment tribunal claims are strictly enforced, and failure to file within the deadline results in dismissal for lack of jurisdiction regardless of the merits of the underlying claim.
