Struck out under rule 39(4) for failure to pay deposit orders of £75 each that were ordered at a preliminary hearing on 20 May 2025. The claimant failed to pay any of the deposits by the required date.
Facts
The claimant brought multiple claims including failure to make reasonable adjustments and indirect discrimination related to disability against Cambridge Regional College. Following a preliminary hearing on 20 May 2025 before EJ Hunt, the claimant was ordered to pay several deposits of £75 each. The order was sent on 27 May 2025 but the claimant failed to pay any of the deposits.
Decision
Employment Judge Quill struck out multiple claims relating to failure to make reasonable adjustments (based on specific PCPs) and indirect discrimination under rule 39(4) of the Employment Tribunals Rules of Procedure 2013 due to the claimant's failure to pay the deposit orders. A hearing scheduled for 24 September 2025 will still proceed for remaining claims.
Practical note
Failure to pay deposit orders will result in automatic strike-out of the claims to which those deposits relate under rule 39(4), even if other claims in the case proceed to hearing.
