Facts
The claimant brought multiple allegations against her employer, City of Bradford Metropolitan District Council. Three specific allegations related to: (1) Ms Taylor contacting her on personal email during sick leave in April 2024, (2) Mr Barratt's failure to timely address concerns in her resignation letter dated 7 May 2024, and (3) Ms Taylor refusing verbal communication after submission of the resignation letter. At a hearing on 3 July 2025, the tribunal made a deposit order of £525 per allegation. The claimant advised on 31 July 2025 that due to personal matters she would not pay the deposit.
Decision
The tribunal struck out the three allegations subject to the deposit order pursuant to rule 40(4) of the Employment Tribunal Procedure Rules 2024. The 28-day time limit expired without payment of the required deposits totalling £1,575. The balance of the claimant's claims remain unaffected by this judgment.
Practical note
A deposit order automatically results in strike out under rule 40(4) if the deposit is not paid within the specified time limit, regardless of the claimant's personal circumstances.
