Facts

This was a preliminary hearing to determine whether the claimant was a disabled person under the Equality Act 2010. The claimant brought claims of direct disability discrimination, unfavourable treatment arising from disability, failure to make reasonable adjustments, and disability related harassment. The tribunal was required to determine disability status in relation to two conditions: anxiety and depression, and Autism Spectrum Disorder.

Decision

The tribunal determined that the claimant was a disabled person at the relevant times due to anxiety and depression, but was not a disabled person due to Autism Spectrum Disorder. All four disability discrimination claims were permitted to proceed to a full merits hearing on the basis of the claimant's disability of anxiety and depression.

Practical note

A preliminary hearing on disability status is a crucial gateway issue in discrimination cases, as claims can only proceed in relation to conditions that meet the statutory definition of disability under section 6 of the Equality Act 2010.
