Outcome
Individual claims
The claim was not presented within the applicable time limit and the tribunal found it was reasonably practicable for the claimant to have presented the claim in time. Therefore the tribunal had no jurisdiction to hear it.
The claim was not presented within the applicable time limit and the tribunal determined it was not just and equitable to extend time to allow the claim to proceed. The tribunal therefore dismissed the claim.

Facts
This was a preliminary hearing to determine time limit issues in relation to claims of unauthorised deductions from wages and discrimination/harassment brought by an unrepresented claimant against two respondents. The claimant's claims were presented outside the applicable time limits.
Decision
The tribunal dismissed all claims on the basis that they were presented out of time. For the unauthorised deductions claim, the tribunal found it was reasonably practicable to have presented in time. For the discrimination and harassment claims, the tribunal decided it was not just and equitable to extend the time limit.
Practical note
Unrepresented claimants face particular challenges with time limits, and tribunals will not necessarily extend time even for discrimination claims if there is no good reason for the delay.
