The claim of dismissal for making protected disclosures was not presented within the applicable time limit and it was reasonably practicable for it to have been presented in time. The tribunal therefore has no jurisdiction to determine this claim.
Facts
Ms Namaji brought claims including whistleblowing detriment and automatic unfair dismissal for making protected disclosures against Humraaz Support Services. A preliminary hearing was held to determine whether the whistleblowing claims were presented in time. The claimant appeared in person while the respondent was represented by a solicitor.
Decision
The tribunal found that the whistleblowing claims were presented outside the applicable time limit and that it was reasonably practicable for them to have been presented in time. All whistleblowing claims were dismissed as being out of time and outside the tribunal's jurisdiction. The claimant's remaining non-whistleblowing claims are permitted to proceed.
Practical note
Strict time limits apply to whistleblowing claims and claimants must demonstrate it was not reasonably practicable to present claims in time to obtain an extension.
