Facts
Mr Thompson brought an unfair dismissal claim against his former employer Lidl GB. The claimant did not attend the preliminary hearing. The respondent was represented by a solicitor, Mrs C Jenkins.
Decision
Employment Judge Leach found that the claim was presented outside the time limit required by section 111 Employment Rights Act 1996 and that it was reasonably practicable for the claimant to have presented it in time. The claim was therefore dismissed.
Practical note
Claimants must comply with strict time limits for unfair dismissal claims, and claims presented late will be dismissed if it was reasonably practicable to present them in time.
