Claimant v Yorkshire Housing Limited
Outcome
Individual claims
The tribunal found the dismissal was fair. Reasons were given orally at the hearing and the claimant did not succeed in establishing unfairness in the dismissal process or reason.
The tribunal concluded that the claimant was not subjected to direct discrimination because of disability. The treatment complained of was not because of the protected characteristic.
The tribunal found no evidence that the claimant was treated less favourably because of his age. The treatment was not related to the protected characteristic of age.
The tribunal determined that the respondent's provision, criterion or practice did not put the claimant at a particular disadvantage, or if it did, it was justified as a proportionate means of achieving a legitimate aim.
The tribunal found that the respondent either made reasonable adjustments or that the adjustments sought were not reasonable in the circumstances. No breach of the duty was established.
The tribunal concluded that the conduct complained of did not meet the statutory test for harassment related to disability. The conduct either did not occur or did not have the requisite purpose or effect.
The claim of unfavourable treatment because of something arising in consequence of disability under section 15 Equality Act 2010 failed. The tribunal found either that the treatment was not unfavourable, not because of something arising from disability, or was justified.
Facts
Mr License brought claims against his former employer Yorkshire Housing Limited alleging unfair dismissal and multiple forms of disability and age discrimination. He represented himself at a five-day hearing conducted remotely, with assistance from his wife. The respondent was represented by counsel. The tribunal heard evidence and submissions on all claims.
Decision
The tribunal dismissed all of Mr License's claims. The tribunal found the dismissal was fair, and none of the discrimination claims were established. The claimant failed to prove direct disability or age discrimination, indirect disability discrimination, failure to make reasonable adjustments, harassment related to disability, or unfavourable treatment arising from disability. Reasons were given orally.
Practical note
A self-represented claimant with multiple disability discrimination claims and unfair dismissal failed to establish any of his claims against a housing provider represented by counsel at a full merits hearing.
