Claimant v University of Hertfordshire

Outcome

Claimant fails

Individual claims

Otherstruck out

The claim was struck out because the Claimant failed to comply with the Tribunal's Order dated 10th March 2025, did not actively pursue the claim, and failed to respond to the case management order requiring representations or a hearing request as to why the claim should not be struck out. The tribunal concluded a fair hearing was no longer possible.

Facts

Ms K George brought claims against the University of Hertfordshire and an individual, Joanna Burrows (case numbers 3309656/2023 and 3302197/2025). The Claimant failed to comply with a case management order dated 10th March 2025 and did not actively pursue the claim. The tribunal issued a case management order on 1st July 2025 requiring the Claimant to make representations or request a hearing as to why the claim should not be struck out. The Claimant failed to respond to this order.

Decision

Employment Judge S Matthews struck out the claim on 6th August 2025 on the basis that a fair hearing was no longer possible due to the Claimant's non-compliance with tribunal orders and failure to actively pursue the claim. Following the strike-out, the Respondent's counterclaim for breach of contract was dismissed upon withdrawal by the Respondent.

Practical note

Claimants must comply with tribunal case management orders and actively pursue their claims, as failure to do so can result in strike-out on the grounds that a fair hearing is no longer possible.
