Facts

The claimant brought claims for unfair dismissal and holiday pay against his former employer, a logistics company. On the morning of a scheduled five-day hearing, the claimant withdrew all claims except unfair dismissal and holiday pay. The respondent then confirmed the holiday pay had been paid and provided evidence. At 1.30pm the same day, the parties informed the tribunal they had reached a drop hands agreement whereby the claimant would withdraw all remaining claims and both parties would cover their own costs.

Decision

The tribunal dismissed all claims upon withdrawal after satisfying itself that the claimant understood the implications of withdrawal, including that he would not be entitled to resurrect his claims once withdrawn and that the proceedings would be ended.

Practical note

A claimant may withdraw all claims on the morning of a hearing as part of a drop hands settlement, provided the tribunal is satisfied they understand the finality of withdrawal.
